Last Revised: October 9, 2012

This website located at www.ecpartners.com (the “ECP Site”) is operated by Energy Capital Partners, LLC and its affiliates (collectively, “ECP,” “we,” or “us”). ECP respects the privacy of every individual who visits the ECP Site. This privacy policy outlines the information that ECP may collect from visitors to the ECP Site, a site hosted in the U.S., and how we may use and disclose that information. Please note that this Privacy Policy solely applies to information we collect on or through the ECP Site and does not apply to information we may have collected through other means.

This policy concerns only the ECP Site and does not concern any website owned and operated by other parties to which the ECP Site may link. We are not responsible for and have no control over the privacy policies of those sites. Links on the ECP Site to other websites are provided only as a convenience and the inclusion of such links does not imply endorsement, recommendation or approval of the linked site. We encourage you to review the privacy policies of those sites to understand how your information is collected and used. Additionally, your Internet or other service provider(s) may collect information about or submitted by you while you use the ECP Site or any other website. We are not responsible for the privacy practices or the operation, content, security or policies, including privacy policies, of any other website that is linked or linking to the ECP Site, and we shall have no liability to you or any other person or entity for the use of, or inability to use, any third party websites. You acknowledge that the information collection and privacy practices of any other party are not monitored or controlled by ECP.

What personal information we collect.

We may collect personal information about you (such as your name, address, telephone number or email address) that you provide voluntarily. For instance, if you choose to contact us through our “contact us” feature, we will collect your personal information so that we can respond to your inquiry.

What other information we collect.

The ECP Site may employ cookies or other technology to gather information about the usage of the ECP Site to help us improve the content, usability and functionality of the ECP Site, and to remember certain user attributes. This helps us better tailor the ECP Site for users and better understand how many new and repeat users visit the ECP Site, which features or pages are most popular, and user browsing and usage patterns. With most Internet browsers, you can erase cookies from your computer hard drive, block all cookies or receive a warning before a cookie is stored. Please refer to your browser instructions or help screen to learn more about these functions. Please be aware, however, that some features and functionality of the ECP Site may be unavailable if cookies are erased or blocked.

Additionally, the ECP Site (as well as HTML emails that we may send to ECP Site users) may use other technical methods to collect data. The data we collect may include your IP address, which operating system and browser you use, how you navigate to and through our site, how long you stay on our web pages, and the websites you access immediately before and after your visit to the ECP Site. This information is generally anonymous and any use of such information will be on an aggregated basis, though if linked to your personal information such data will also be treated as personal information.

How we use the information we collect.

We reserve the right to use any information we collect for reasonable business purposes and in any manner permitted by law. For example, we may use the information we collect for our internal marketing, research and other business purposes, or to send you communications regarding ECP or features of the ECP Site, including changes to the ECP Site which may affect your access to or use of all or part of the ECP Site and/or the products and services available through the ECP Site.

We may employ third party vendors to perform functions on our behalf, including operating certain features of the ECP Site, hosting or maintaining servers used in connection with the ECP Site, or sending postal mail or email. These vendors may have access to your personal information and other information solely as necessary to carry out their functions. Further, such third parties are required to maintain the confidentiality of the information disclosed to them consistent with this Privacy Policy, and are prohibited from using personal information disclosed for any purpose other than as required for their provision of the applicable services to ECP.

We may also use and disclose your personal and non-personal information as necessary to our business advisors (e.g. attorneys, accountants and auditors), to law enforcement entities or self-regulatory groups (to the extent permitted or required by law), to comply with federal, state or local laws, rules or regulations, to comply with subpoena or other judicial process, to respond to summons or other requests from authorized government authorities, or in connection with a proposed or actual sale, merger, transfer or exchange of all or a portion of ECP, any ECP subsidiary or affiliate, or any line of business associated with ECP.

We may share information you provide through the ECP Site with other companies that are controlled, owned or operated by ECP or ECP subsidiaries and affiliates. Such ECP subsidiaries and affiliates will not disclose your personal information for marketing purposes unless you consent to this use.

We will not intentionally sell or rent your personal information to any unaffiliated third party for marketing purposes unless you consent to this use. However, we may provide unaffiliated third parties with aggregate non-personal information about visitors to the ECP Site (such as statistical information derived from personal information submitted by ECP Site visitors). Such aggregated information will not identify any particular visitor to the ECP Site.

How we protect your personal information.

We take measures to prevent unauthorized intrusion to the ECP Site and the alteration, acquisition or misuse of personal information by unauthorized persons. We restrict access to nonpublic personal information about you to those employees or servicers who need to know the information to provide products or services to you. ECP maintains physical, electronic and procedural safeguards to guard your nonpublic personal information. Please be aware, however, that no security measures are perfect or impenetrable. We will not be responsible or liable for any damages, losses or causes of action arising out of or in connection with the disclosure of any information we collect.

Amendments to this Privacy Policy.

ECP reserves the right in the firm’s sole discretion to modify or amend this Privacy Policy or any other terms associated with the use of the ECP Site in any way at any time. Any such changes shall become part of this Privacy Policy and are effective upon posting on the ECP Site. You should review this Privacy Policy periodically for changes applicable to you. By accessing the Site subsequent to any such modification, you are deemed to have agreed to all terms of this Privacy Policy as modified or amended.
